If you're in a same sex de facto relationship in Australia, you generally have the same legal rights as a married couple. To access these rights, such as in property settlements, and spousal maintenance you must either have been in the relationship for at least two years, or have registered your relationship.

What are the same sex marriage laws in Australia?
Same-sex marriage has been legal in Australia since 9 December 2017. The law defines marriage as the union of two people, regardless of gender.
Same-sex couples now have the same legal rights as heterosexual couples, including in areas like property division, spousal maintenance, and parenting. Overseas same-sex marriages are also recognised under Australian law.
What are the same sex divorce laws in Australia?
In Australia, same-sex divorce follows the same legal process as any other divorce. To apply, you must have been separated for at least 12 months and demonstrate that the marriage has irretrievably broken down. This applies to both marriages conducted in Australia and those legally recognised from overseas.
After divorce, you have 12 months to initiate court proceedings for property settlement or spousal maintenance. Parenting arrangements are handled under the same laws, regardless of gender or sexual orientation.
